TERMO CONSENTIMENTO

Prezada(o) Cliente,

Somos gratos pela acertada escolha em participar de nosso curso, bem como em aperfeiçoar seus conhecimentos sobre os nossos produtos, técnicas, métodos e protocolos, especialmente desenvolvidos para a promoção da saúde, estética e bem-estar de nossos consumidores.

Bothanica Mineral ® • é uma marca pertencente à empresa Amazônia Brasileira Comércio de Cosméticos, Cosmecêuticos e Nutracêuticos. ("Empresa") e todos os nossos produtos, técnicas, métodos e protocolos estéticos são resultado de grande investimento em pesquisa, desenvolvimento e aperfeiçoamento baseado nos mais avançados testes de segurança e eficácia.

Por esta razão, a partir de sua participação em nosso curso, você terá acesso a informações privilegiadas e transferência de conhecimentos, que gerarão significado para a vida, e cujas patentes, direitos intelectuais e autorais estão devidamente protegidos perante o Instituto Nacional de Propriedade Intelectual - INPI, em conformidade com a legislação em vigor, no Brasil e Exterior.

Deste modo, para que possamos preservar nosso patrimônio intelectual, pedimos que manifeste sua aceitação às condições abaixo, bem como mantenha sigilo e confidencialidade sobre todas as informações que são transmitidas, responsabilizando-se, nos termos da lei, a não divulgá-las a terceiros, por qualquer meio, inclusive com referência ao teor constante dos materiais publicitários e educativos recebidos, bem como nas técnicas, protocolos, processos de aplicação de produtos que aprenderá no presente Curso.

Este Termo de Compromisso é firmado em conformidade com a legislação brasileira e internacional, pertinentes. Assim, como o aceito virtual do presente Termo, são também aceitas e ratificadas as seguintes declarações:

i) Declaro que tive prévio conhecimento do caráter obrigatório e incondicional de prestar informações verdadeiras para a Bothanica Mineral ®, estando ciente que tais informações se prestam a inserir/complementar dados pessoais e demonstrativos de minha capacitação profissional, essenciais para utilização dos produtos, podendo, inclusive, este termo ser usado como prova documental para todos os fins de Direito.

(ii) Declaro, também, serem verdadeiras todas as afirmações fornecidas neste formulário, bem como sendo verdadeiros os documentos eventualmente anexados, estando ciente que a não veracidade poderá acarretar a instauração dos competentes processos judiciais, em instância cível e criminal, inclusive pela prática de CRIME DE FALSIFICAÇÃO DE DOCUMENTO.

(iii) Declaro que não integro o quadro de funcionários, prepostos e/ou figuro como parceiros comerciais de empresas concorrentes do mesmo seguimento da Bothanica Mineral ®, para todos os fins de direito e sob as penas da lei penal.

(iv) Inscrições são pessoais e intransferíveis, ou seja, não é possível transferir a terceiro.

(v) Não é permitido transferir a inscrição para outro percurso, curso, mini curso, workshop, palestra, road show e afins, nem tampouco transferir a cidade.

(vi) Identificada pela Bothanica Mineral® qualquer quebra do compromisso de sigilo e confidencialidade, violação de direito intelectual e/ou qualquer outro ato que prejudique ou tenha o condão de prejudicar a reputação da empresa ou de terceiros, esta poderá, a seu exclusivo critério e sem prévio aviso, tomar as seguintes providências:

proibir o infrator de fazer qualquer alusão a nossas marcas e produtos;
dependendo da gravidade do caso, a seu exclusivo critério, efetuar o descredenciamento do infrator da base de cliente da Bothanica Mineral®;
sem prejuízo das demais medidas extrajudiciais aplicáveis, a Bothanica Mineral® poderá encaminhar todas as medidas judiciais que entender cabíveis para elidir qualquer prática criminosa, buscar indenizações por perdas e danos e encaminhar o caso para as autoridades competentes visando à penalização do infrator.

Como forma de prestar o melhor serviço às inscritas(os) neste Curso, é importante frisar alguns dos serviços que serão prestados após o término deste e por quanto tempo.

i) Para a melhor organização e aproveitamento na troca de informações, a Bothanica Mineral® vai inserir cada participante em um Grupo fechado do What’sApp.

(ii) Serão respondidas o máximo de perguntas possíveis, desde que tenham relação com o tema abordado e que sejam enviadas ao administrador do Grupo.

(iii) Caso o curso tenha sido online, este permanecerá por três meses aberto e a disposição do aluno, dentro da Plataforma Bothanica Mineral ®.

(iv) Todos os Certificados oriundos de todos os cursos, online ou presenciais, patrocinados pela empresa Bothanica Mineral ® serão entregues fisicamente no evento do curso e virtualmente contendo: 1) Código do Certificado; 2) QR Code; 3) Link para verificar de veracidade do mesmo.

(v) O(A) aluno(a) é o(a) único(a) e exclusivo(a) responsável, direta, indireta ou regressivamente, pelos riscos da atividade que desenvolve e pela sua rede de negócios (equipe), sem qualquer responsabilidade solidária ou subsidiária da Bothanica Mineral ® em caso de reclamação judicial ou extrajudicial.

EM TESTEMUNHO DO QUE, as PARTES reconhecem e anuem expressamente a veracidade, autenticidade, integridade, validade e eficácia deste Instrumento, contendo sete (3) três páginas, assinado em formato físico, eletrônico e/ou por meio de certificados eletrônicos, inclusive os que utilizem certificados não emitidos pela ICP-Brasil, nos termos do art. 10, § 2º da Medida Provisória nº 2.200-2 de 24 de agosto de 2001 (“MP nº 2.200-2”).

Dear Customer,

We are grateful for the right choice to participate in our course, as well as to improve their knowledge about our products, techniques, methods and protocols, specially developed to promote the health, aesthetics and well-being of our consumers.

Bothanica Mineral ® • is a brand belonging to the company Amazônia Brasileira Comércio de Cosméticos, Cosmeceuticals and Nutraceuticos.

("Company") and all of our products, techniques, methods and aesthetic protocols are the result of great investment in research, development and improvement based on the most advanced tests of safety and effectiveness.

For this reason, from your participation in our course, you will have access to privileged information and knowledge transfer, which will generate meaning for life, and whose patents, intellectual and copyright rights are properly protected before the National Institute of Intellectual Property - INPI, in accordance with the legislation in force, in Brazil and abroad.

Thus, in order for us to preserve our intellectual heritage, we ask that you express your acceptance of the conditions below, as well as maintain secrecy and confidentiality on all information that is transmitted, taking responsibility, under the terms of the law, not to disclose it to third parties. , by any means, including with reference to the content contained in the advertising and educational materials received, as well as in the techniques, protocols, product application processes that you will learn in this Course.

This Term of Commitment is signed as provided for in article 428, I, second part, of the Brazilian Civil Code that provides: The person who hires by telephone or similar communication is also considered present. I also declare that all the statements provided in this form are true, as well as the documents that may be attached are true, being aware that non-veracity may lead to the establishment of the competent judicial processes, in both civil and criminal instances, including the practice of DOCUMENT FALSIFICATION CRIME, provided for in Article 298 of the Penal Code, which provides for a penalty of UP TO 5 (five) years in prison when someone: "Falsify, in whole or in part, a private document or change a true private document".
I declare that I am not part of the staff, representatives and / or figure as business partners of companies competing with the same segment as Bothanica Mineral®, for all legal purposes and under penalties of criminal law.
Cancellation of registration may be made 72 (seventy-two) hours before the course term, with a refund of 70% of the amount paid, after that, there will be no refund of the investment.
Registrations are personal and non-transferable, that is, it is not possible to transfer to a third party.
It is not allowed to transfer the registration to another route, course, mini course, workshop, lecture, road show and the like, nor to transfer the city.
If any breach of the commitment to secrecy and confidentiality, violation of intellectual rights and / or any other act that harms or has the ability to damage the reputation of the company or third parties is identified by Bothanica Mineral ®, it may, at its sole discretion and without prior notice, take the following measures:
prohibit the infringer from making any reference to our brands and products;
depending on the severity of the case, at its sole discretion, disqualify the infringer from Bothanica Mineral®'s customer base;
without prejudice to the other applicable extrajudicial measures, Bothanica Mineral® may refer all judicial measures that it considers appropriate to eliminate any criminal practice, seek damages for losses and refer the case to the competent authorities aiming at penalizing the infringer.

As a way of providing the best service to those enrolled in this Course, it is important to stress some of the services that will be provided after the end of this Course and for how long.

For the best organization and use in the exchange of information, Bothanica Mineral® will insert each participant in a closed group of What’sApp.
As many questions as possible will be answered, as long as they are related to the topic addressed and are sent to the Group administrator.
If the course was online, it will remain open for three months and at the student's disposal, within the Bothanica Mineral® Platform.
All Certificates coming from all courses, online or in person, sponsored by the company Bothanica Mineral® will be physically delivered at the course event and virtually containing: 1) Certificate Code; 2) QR Code; 3) Link to verify its veracity.
The student is the only and exclusive person responsible, directly, indirectly or regressively, for the risks of the activity he develops and for his business network (team), without any joint or subsidiary liability of Bothanica Mineral® in the event of a judicial or extrajudicial claim.

Estimado cliente,

Estamos agradecidos por la acertada elección de participar en nuestro curso, así como por mejorar su conocimiento sobre nuestros productos, técnicas, métodos y protocolos, especialmente desarrollados para la promoción de la salud, la estética y el bienestar de nuestros consumidores.

Bothanica Mineral® • es una marca perteneciente a la empresa Amazônia Brasileira Comércio de Cosméticos, Cosmeceuticos ed Nutraceuticos. ("Compañía") y todos nuestros productos, técnicas, métodos y protocolos estéticos son el resultado de una gran inversión en investigación, desarrollo y mejora basada en las más avanzadas pruebas de seguridad y eficacia.

Por tal motivo, a partir de su participación en nuestro curso, tendrá acceso a información privilegiada y transferencia de conocimiento, que generará sentido para la vida, y cuyas patentes, derechos de propiedad intelectual y derechos de autor están debidamente protegidos ante el Instituto Nacional de Propiedad Intelectual - INPI, de acuerdo con la legislación vigente, en Brasil y en el exterior.

Por ello, para que podamos preservar nuestro patrimonio intelectual, le pedimos que exprese su aceptación de las condiciones a continuación, así como que mantenga el secreto y la confidencialidad sobre toda la información que se transmita, responsabilizándose, en los términos de la ley, de no divulgarla a terceros, por cualquier medio, incluso con referencia a los contenidos contenidos en los materiales publicitarios y educativos recibidos, así como en las técnicas, protocolos, procesos de aplicación de productos que aprenderás en este curso.

Este Término de Compromiso se firma en los términos previstos en el artículo 428, I, segunda parte, del Código Civil brasileño que establece: También se considera presente la persona que contrata por teléfono o comunicación similar. Así, como virtual aceptación de este Plazo, también se aceptan y ratifican las siguientes declaraciones:

i) Declaro tener conocimiento previo del carácter obligatorio e incondicional de brindar información veraz a Bothanica Mineral®, siendo consciente que dicha información tiene como finalidad insertar / complementar datos personales y demostración de mi formación profesional, imprescindible para el uso de los productos, pudiendo, este término se utiliza incluso como prueba documental a todos los efectos de la ley.

(ii) También declaro que todas las manifestaciones aportadas en este formulario son verdaderas, así como los documentos que se adjunten son verdaderos, siendo consciente que la no veracidad puede conducir al establecimiento de los procesos judiciales competentes, tanto en instancias civiles como penales, incluyendo la práctica de DELITO DE FALSIFICACIÓN DOCUMENTAL, previsto en el artículo 298 del Código Penal, que prevé la pena de HASTA 5 (cinco) años de prisión cuando alguien: "Falsifique, total o parcialmente, un documento privado o modifique un verdadero documento privado".

(iii) Declaro que no formo parte del personal, representantes y / o figura como socio comercial de empresas competidoras del mismo segmento que Bothanica Mineral®, para todos los efectos legales y bajo pena de derecho penal.

(iv) La cancelación de la matrícula podrá realizarse 72 (setenta y dos) horas antes del término del curso, con devolución del 70% del monto pagado, luego de eso, no habrá devolución de la inversión.

(v) Los registros son personales e intransferibles, es decir, no es posible transferirlos a un tercero.

(vi) No se permite trasladar la inscripción a otro curso, mini curso, taller, charla, road show y similares, ni trasladar la ciudad.

(vii) Si Bothanica Mineral® identifica cualquier incumplimiento del compromiso de secreto y confidencialidad, violación de los derechos intelectuales y / o cualquier otro acto que dañe o tenga la capacidad de dañar la reputación de la empresa o de terceros, podrá, a su sola discreción y sin previo aviso, tomar las siguientes medidas:

(a) prohibir al infractor hacer referencia a nuestras marcas y productos;

(b) dependiendo de la gravedad del caso, a su entera discreción, descalificar al infractor de la base de clientes de Bothanica Mineral®;

(c) sin perjuicio de otras medidas extrajudiciales aplicables, Bothanica Mineral® podrá remitir todas las medidas judiciales que considere oportunas para eliminar cualquier práctica delictiva, buscar indemnización por daños y perjuicios y remitir el caso a las autoridades competentes para sancionar al infractor.

Como forma de brindar el mejor servicio a los inscritos en este Curso, es importante resaltar algunos de los servicios que se brindarán una vez finalizado este Curso y por cuánto tiempo.

i) Para la mejor organización y uso en el intercambio de información, Bothanica Mineral® insertará a cada participante en un grupo cerrado de What’sApp.

(ii) Se responderán tantas preguntas como sea posible, siempre que estén relacionadas con el tema abordado y sean enviadas al administrador del Grupo.

(iii) Si el curso fue online, permanecerá abierto durante tres meses y a disposición del alumno, dentro de la Plataforma Bothanica Mineral®.

(iv) Todos los Certificados de todos los cursos, en línea o en persona, patrocinados por la empresa Bothanica Mineral® se entregarán físicamente en el evento del curso y contienen virtualmente: 1) Código de Certificado; 2) Código QR; 3) Enlace para verificar su veracidad.

(v) El alumno es el único y exclusivo responsable, directa, indirecta o regresiva, de los riesgos de la actividad que desarrolla y de su tejido empresarial (equipo), sin cualquier responsabilidad conjunta o subsidiaria de Bothanica Mineral® en caso de reclamación judicial o extrajudicial.

EN TESTIMONIO DE LO CUAL, las PARTES reconocen y consienten expresamente la veracidad, autenticidad, integridad, vigencia y efectividad de este Instrumento, que contiene três (3) páginas, firmadas en formato físico, electrónico y / o mediante certificados electrónicos, incluidos los que utilizan certificados no emitidos por ICP-Brasil, de conformidad con el art. 10, § 2 de la Medida Provisional No. 2.200-2 de 24 de agosto de 2001 (“MP No. 2.200-2”).
